IN CP the embassies request the visa number before it schedules the interview for the applicant.
For example: If the applicant interview is scheduled in August 14th 2007 the interview letter will be sent 3- 4 weeks before(in July 2007). They request the visa number in July at the time they send interview letter.
All the people who attended CP interviews in July got Visa Number and hence are approved till July 31st.

(1) The reason for amendment denial
(2) Whether the employer is exploiting him due to his ignorance
(3) Whether the employer is abusing the immigration system.
BTW, Dig through my posts on this thread and other - You will realize that I'm against everyone who abuses the system.

Doesnt make sense to pay $2500 for retaining the lawyer, they are trying to squeeze maximum out of you. If you are changing employer ask if the new company has an immigration lawyer and you can have him for your services. If they dont have any one you can engage services of your own immigration lawyer and have the new lawyer sign the G-28 form. Also please post the name of law firm and your employer so that others can be cautious.

1) You need to fill the form G-639 to get the I-140 documents.
2) Provide as much Information as possible about your case. Some of you doesn't have the Receipt Number, they may also fill the form G-639 and provide any other information you have. (Ex: Provide with thorough description of your case in a separate paper.)
3) After filling the form, Notarise it (Your bank will do it)
4) Attach all the documents with this form and send it to:

I have a Green card and also my wife has GC .My wife is expected to deliver a baby.Shw wants the delivery to be in India and then come back...in that case what VISA will the new baby have to apply US when my wife returns back to US.

Vivek Wadhwa spoke very nicely and hit right at the core of the EB Immigration issues and backlog. I talked to him along with my wife and told our story. I also told that lot of people like me will be opting Canada or Australia or even go back to India if the EB Immigration issues are not fixed. If US doesn't fix its Immigration Policies for Skilled Immigrants then they go back to their home countries or other contries who know their worth. This is our most productive age and we won't waste it.

First and foremost we are a nation of laws, or as we are all anticipated? But years of previous administrations have neglected the illegal immigrant problem, to the detriment of American workers. Ever since the inception of the 1986 Immigration & Reform Act, signed into law by Ronald Reagan, the politicians have pushed for a new AMNESTY. In addition, anytime a new law has been drafted to combat the illegal immigrant occupation of our country, they have behind closed doors killed it or weakened it's enactment. The law of given instant citizenship to babies intentionally born here, is a complete misinterpretation of the 14th amendment, after the civil war that emancipated African slaves.
It was never meant for (Anchor Babies) to give pregnant illegal alien mothers the right to legal status? The law has been badly mauled because the children can then draw on US education, free medical care, free baby delivery and after care, low income housing and it is a route to many government handouts. The major problem now facing the Obama White House is are the children of illegal immigrants to blame for their parents breaking the law? Obviously the left-wingers are to blame for this conundrum, but both parties have added to neglect to the sovereign laws of our nation. I think we should follow other countries "Rule of Law" and cement in place that children who have proven themselves can go to a place of higher learning. We desperately need a wide scope of professionals in Engineering, Science and 21st Century technology. But also remember that our government settles the largest population of new immigrants on Earth. What we don't need is more poorly educated, non-English speaking, impoverished aliens, looking for handouts. Like other developed nations we must be very specific, who we pick and choose as new citizens. We must also restrain ourselves from chain migration, who are liable to become a public charges, because the family sponsors have decided the US taxpayer should carry the financial weight?
We can thank our corrupt liberal politicians, judges in the past as drafting a passive law, instead of entering America being a criminal offense. Now we have uncountable number of illegal aliens squatting here, because of the absolute intentional neglect of our lawmakers. Is there any other country in the world, that makes illegally crossing into their sovereign territory a Civil Crime--I really don't think so? Our laws deliberately drafted this way in favor of the open border, big Catholic church and special interest groups. To HXXX with the American people, who are forced to fight for their jobs?
But if American defeat the next Amnesty ready to pounce on the unsuspecting legal population, we must make an example in using the 1986 law. We as a people must build-on the E-Verify application, upgrade, modify to extract illegal job applicants from the workplace. This will surely happen when Sen. Reid, Speaker Pelosi and 48 other Senate lawmakers come up for re-election. They underfunded E-Verify, that obviously is working efficiently for them to kill it. Today I have heard Homeland Security Chief Janet Napolitano is approaching State governors to appeal the Real ID Act, that would add national standards for state-issued driver licenses and non-driver identification cards, Revising and tightening the laws on application for asylum and deportation of aliens for terrorist activity. That wouldWaiver laws that interfere with construction of physical barriers at the borders, to name a few statutes. So that means since the new Presidency, the Democratic run Congress are trying to revoke E-Verify and the Real ID act. My guess, is under this regime they will be rescinding the Federal program for State and local police called 247(g) that trains officers to arrest and detain illegal alien criminals.
The open border, free traders, special interest groups will use any contradictions, epithets, racial slurs to annul any new law--which they have done successfully up to now. I have a couple of questions:
1. In the AP application form, there is a question on when you intend to travel. What should I enter there when I am only applying for some future travel and am not sure about the dates?
2. I had worked on OPT after my graduation before switching to H1 visa. So when I apply for EAD now, should I apply as a renewal applicant or a new applicant? Is OPT the same as EAD?

Hi There,
I work in Company A, and Company A filed my GC April 2008 under EB2 Category.
Priority Date: April 2008
I-140: Approved
I-485- To be Filed
I also have a Masters Degree in the US.
I received an offer from Company B (Top consulting Firm) and they are willing to process my GC but in EB3 Category.
My Current H1 will expire in May 2012.
My wife is in the health care profession and currently a student in school and should get a a job next year. She is on a F1 currently and she should apply for a H1 next year. I am assuming that she can file for a GC in the EB2 category.
Questions:
1. Does it make sense to take up the offer or just wait for my I -485 date to become current. If i do not take up the offer, then i would lose out from a career growth perspective.
2. If i take up the offer and apply in the EB 3 category, hoping that my wife�s GC would be filed in EB2, can i apply I -485 with her.
3. Finally, does it make any sense to apply in EB3?
Your advice would be appreciated...

I have filled I-485 in 2007, PD is June 2006, EB2. I went to India and came back using my AP on 07/16/2008. I was working for the same company when I came back. I have changed my employer in April, and haven't filled for AC21 yet.
Can you please help me with following question?
My Question is: Will it be Okay to travel using Advance Parole after changing employer and not filled AC21? If anyone traveled like this, Can you please let me know what documents do I need to take with me?

You can do anything as long as you don't get caught. In this case. If he moved from a developer to a PM. That in itself is a significant change in job description.
I have heard one of the lawyers say that a developer to a PM is a natural job progression. That does not make sense at all. You go from debugging your code to debugging MS-Project. The associate Director post involves something entirely different.
IF the company is willing to go along and provide the letter with the same designation as in LC, then there is nothing to worry else you would have a sword hanging till the case is adjucated.

If you filed in PERM system, you should be able to find your case. I was able to see my case based on the LC case number. DOL has database for fiscal years 2003 thru 2006.
This is useful, but I doubt its accuracy because some of the cases I know - including mine - are missing !!

Ruchigup, Are you sending AC21 document? I am also leaving my current employer and taking AC21 route. I am retaining my lawyer. He is supportive and hopefully, will not ask retainer fee as he knows that i paid all my gc cost.

From waht i gather, one can have concurrent H-1Bs and work for two employers in H-1B status. It would require filing a concurrent H-1B portability petition to start with employer B. I guess, normally they would revoke H-1B status but in that case won't. With the new employer they'd request concurrent employment so USCIS will know about two employers.
I guess the only question with this is timing of my travel plans to Germany - i.e. could one do file this now and then get the new stamp while in Germany..... Whoever said this ain't complicated????

If I read the USCIS news, then these are the questions I would ask myself and see if there is any serious legal concern...
1. Was I in non-pay status while working for VSG?
2. Is my job and location same as in my H-1B labor certification?
3. Are there any false documents submitted on my behalf to USCIS to support my visa petition?
If you answer no to all these questions, then legally you should be safe. However, as a further precaution, I would suggest to use AC-21 and move to another company. File a fresh labor (you can still claim the priority date from your old labor) and distance yourself from the fraudsters.
